These terms are the contract between you and (being completed) for using the einvestitii.ro website and its services. We have written them as clearly as we can. Where the law gives you additional rights, those rights apply anyway, even if we do not repeat them here.
1. Who we are
The einvestitii.ro website is operated by (being completed), (being completed), with its registered office at (being completed), Trade Register number (being completed), unique registration code (being completed) (“we”). Our full details and contact channels are on the Legal Notice page.
You can write to us at any time at zmentaro@gmail.com. To report illegal content, use the reporting form. For anything about your personal data, write to zmentaro@gmail.com.
2. Which documents form the contract
Our contract with you is made up of these Terms and of the documents they refer to, each for its own subject:
- the Community Rules, for posts, comments, polls and profiles;
- the Subscription Terms, if you pay for a subscription;
- the Points, Predictions and Leaderboard Rules;
- the “Invite Friends” Programme Rules.
We explain how we handle your personal data in the Privacy Policy and the Cookie Policy. These documents inform you; they are not clauses you agree to. The nature of the information on the site is explained in the Disclaimer, the Investment Risk Warning and the Investment Recommendations (MAR) and Conflicts of Interest page.
If a specific document says something different from these Terms, the specific document applies for its own subject.
3. What we offer
einvestitii.ro is an information and analysis platform about the financial markets. In short:
- pages on stocks, ETFs, indices, crypto, currencies and commodities, with market data, indicators and explanations;
- scores and verdicts calculated automatically by a quantitative model, described in the Methodology;
- news, summaries and translations, some written with the help of artificial intelligence and labelled as such (see Artificial Intelligence and Editorial Policy);
- a community: profiles, posts, comments, polls, predictions, points and a leaderboard;
- personal tools: watchlists, alerts, saved items, notifications and digest emails;
- pages about brokers and crypto platforms, some with affiliate links (see Affiliate Links and Advertising).
What you can see depends on your access level: some content is public, some requires a free account (for example, 3 full analyses per month), and the rest requires a subscription. What each level includes is described on the pricing page.
4. We do not provide investment advice
The information on the site, including scores, verdicts, fair values, projections, news and user posts, is general. It does not take into account your financial situation, your objectives or your risk tolerance, and it is not a personal recommendation.
We are not an investment firm. We are not authorised or supervised by the ASF (the Romanian Financial Supervisory Authority) or by any other authority for investment services. We do not accept orders, manage money or arrange transactions.
Your investment decisions are your own and you make them at your own risk. Before investing, read the Investment Risk Warning and, if you need a recommendation suited to you, ask an authorised adviser.
5. Your account
5.1. Who can have an account
You may only have an account if you are at least 18 years old and have full legal capacity. You confirm this when you register. If we find out that an account belongs to a minor, we close it.
5.2. One account, with real details
- Each person has a single account. Multiple accounts used to get around limits, sanctions or leaderboards will be closed.
- Your display name and @username must not imitate another person, a company, an authority or our team.
- Your email address must be yours and must work: it is where you receive confirmations, invoices and important notices.
5.3. Account security
You keep your password secret and do not share your account with anyone. You tell us straight away if you suspect someone has used your account. You can also sign in with Google or Telegram; in that case, the rules of those services apply as well.
5.4. Badges
The badge on our team's official accounts shows that an account belongs to us. The subscriber badge only shows that the person has an active subscription. No badge means that we verify anyone's identity, expertise or claims.
6. What you can do with the information on the site
We give you a personal, non-exclusive and non-transferable right to use the site for your own needs, not for commercial purposes. You may quote short extracts with a reference to the source (a link to our page).
Without our written consent, you may not:
- copy, republish or sell our analyses, scores, verdicts, data or texts, in full or in substantial parts;
- extract data using robots, scripts or other automated means (scraping), get around technical limits or overload our servers;
- use our content to train or feed artificial intelligence systems. We expressly reserve this right within the meaning of the text and data mining rules (Article 4 of Directive (EU) 2019/790 and Law no. 8/1996), including in machine-readable form, in the site's robots.txt file;
- get around payment, share subscriber access or resell access.
Some market data comes from third-party providers, who have their own terms. You may not redistribute it.
The site, its design, texts, models and databases are protected by copyright and by the sui generis database right (Law no. 8/1996 on copyright and related rights). The trade marks and logos of the companies shown belong to their owners and appear only for identification.
7. Content you publish
7.1. It stays yours
Your posts, comments, polls, images and profile texts remain yours. You give us a non-exclusive, royalty-free, worldwide licence to host them, display them, adapt them technically (for example, to resize an image) and show them in the feed, in emails, in search results and in search engines, for as long as they are published on the site.
The licence ends when you delete the content or your account, with two exceptions: backup copies, which are deleted in their normal cycle, and content we must keep for legal reasons (for example, in a notice or an investigation).
7.2. You are responsible for what you publish
- You only publish what you have the right to publish: your own texts, and images that are yours or that you are allowed to use.
- You follow the Community Rules and the law, including the rules on market abuse.
- When you recommend or suggest an investment, you are the producer of that recommendation. You keep facts separate from opinions and say whether you hold the instrument you are writing about (that is what the “I own shares” tick box is for).
7.3. We do not check everything in advance
We do not review user content before it is published and we do not approve it. Opinions in the community belong to their authors, not to us.
8. How we moderate
As required by Regulation (EU) 2022/2065 on digital services (the Digital Services Act, DSA), this section explains which restrictions we may apply and how. The details are on the Moderation and the Digital Services Act (DSA) page.
8.1. What we use
- Automated filters against scams and spam: words, domains, links to groups, phone numbers, link shorteners. A filter may block a post or hold it for review.
- User reports. For the most serious grounds (content involving minors, sexual content, threats), a report from a trusted account (confirmed, more than 7 days old, and with no more than one of its serious reports rejected) can hide the content immediately, until a person reviews it. For all other grounds, content is hidden after 3 reports from confirmed accounts that are more than 7 days old.
- Human review: final decisions, appeals and serious cases are decided by a person on our team.
8.2. What measures we may take
In proportion to how serious the breach is and whether it is repeated:
- hiding or removing a post, a comment or an image;
- reducing visibility (for example, removing it from the feed or from search engines);
- a warning;
- temporarily restricting posting and commenting;
- suspending or closing the account.
8.3. We tell you why
When we take a measure against your content or your account, you receive a statement of reasons by email: what we did, for how long, based on which facts, under which rule or law, whether the decision was automated, and how you can appeal. The exceptions are deceptive high-volume commercial content (spam) and cases where an authority asks us not to inform you.
8.4. Appeals
You can appeal any decision within 6 months, using the reporting form (choose “Appeal a moderation decision”) or by replying to the email you received. A person reviews it, where possible someone other than the person who made the decision, and we reply with our reasons. You also have the right to turn to an out-of-court dispute settlement body certified under the DSA, or to go to court.
8.5. Misuse of reporting
If you frequently submit manifestly unfounded reports, we will, after a warning, suspend the processing of your reports for a reasonable period (Article 23 of the DSA).
9. Predictions, points and leaderboard
Points, levels, predictions and the leaderboard are a community game, with no stakes and no prizes. Points have no monetary value, cannot be sold, bought or transferred, and cannot be exchanged for anything. The rules are in the Points, Predictions and Leaderboard Rules.
10. Subscription
The paid subscription, its price, payment, renewal, cancellation, the 14-day withdrawal right and refunds are described in the Subscription Terms.
11. Links to other websites, affiliate links and advertising
Some links to brokers and crypto platforms are affiliate links: if you open an account through them, we may receive a commission, at no cost to you. We label them clearly. Advertising spaces are labelled “Advertisement” and are not shown to subscribers.
Our partners' websites are not ours. You enter into a contract directly with them, under their rules, and we are not responsible for their services. The details are in Affiliate Links and Advertising.
12. Availability and changes to the service
We do everything we can to keep the site running without interruptions, but we do not guarantee that it will always be available or error-free, or that data will be real-time. There may be maintenance, outages at our data providers or delays.
We may improve, change or discontinue features for technical, legal, security or service development reasons. If you have a subscription and a change has a significant negative effect on your access to what you paid for, we will tell you by email in advance and you may end the contract free of charge, within 30 days of the notice or of the change, with a refund of the unused part (under Government Emergency Ordinance (OUG) no. 141/2021 on contracts for the supply of digital content and digital services).
13. Termination
13.1. By you
You can delete your account at any time from Account → My data → Delete account. Deleting your account ends your subscription, without a refund for the remaining period. If you are still within 14 days of payment, withdraw from the contract first, so that you get your money back for the days you have not used (see the Subscription Terms). What we keep after deletion, and for how long, is explained in the Privacy Policy.
13.2. By us
We may suspend or close an account, with a prior warning where appropriate, if:
- you seriously or repeatedly breach these Terms or the Community Rules;
- you use the site for fraud, scams, market manipulation or other illegal acts;
- an authority or a court requires us to;
- the account has been unconfirmed for more than 7 days (it is deleted automatically).
We will explain the reason for the measure and how long it lasts by email, except where the law prohibits us from doing so. If we close a subscriber's account for any reason other than fraud, we refund the unused part of the subscription.
14. Our liability
We are liable to you in accordance with the law for damage caused intentionally or through gross negligence, for injury to life or health, and for the rights that consumer law does not allow us to limit. For everything else:
- we are not liable for investment decisions made on the basis of information on the site, or for trading losses;
- we are not liable for errors, delays or gaps in data received from third-party providers, if we used that data in good faith;
- we are not liable for content from users, partners or external websites;
- we are not liable for loss of profit or for indirect damage;
- in any other case, our total liability to a user is limited to the amount that user paid in the last 12 months or, if they paid nothing, to RON 100.
If you are a consumer, the limits above do not apply if we fail to perform our main obligation, which is to give you access to the paid service.
15. Your liability
If you breach the law or these Terms and, as a result, someone claims compensation from us (for example, for content you published), you are liable for the proven damage, as provided by law.
16. Clauses you expressly accept
Under Article 1203 of the Romanian Civil Code, certain clauses only take effect if you accept them expressly. You accept them expressly by ticking the separate box at registration (or at the first step after signing in with Google or Telegram). You also expressly accept automatic renewal at payment. The clauses are:
- the limitation of our liability (section 14);
- our right to suspend or close your account and to restrict content (sections 8 and 13.2);
- our right to change features of the service (section 12) and these Terms (section 17);
- the automatic renewal of the subscription (Subscription Terms);
- the governing law and the competent courts (section 18).
17. Changes to the Terms
We may change the Terms when there are changes to the law, to the requirements of the authorities, to the features of the service or to our security measures. Each version has a number and an effective date, and previous versions remain public on this page.
- Important changes (those that reduce your rights or add obligations) are announced to you by email and in your notifications at least 30 days before they take effect, with a summary of the changes. We ask for your consent to them again the first time you sign in after they take effect.
- Corrections (typos, clarifications, contact details) take effect when they are published.
If you do not agree with an important change, you may close your account before it takes effect. If you have a subscription, we refund the unused part.
18. Governing law and disputes
The contract is governed by Romanian law. If you are a consumer living in another Member State of the European Union, you keep the protection given to you by the mandatory rules of your country.
We first try to resolve any complaint directly: write to us at zmentaro@gmail.com and we will reply within 30 days at most. If you are a consumer, you can also contact ANPC (the Romanian National Authority for Consumer Protection) or use the alternative dispute resolution procedure (SAL). The competent ADR entity is the Alternative Dispute Resolution Directorate (Direcția Soluționarea Alternativă a Litigiilor) within ANPC: anpc.ro/ce-este-sal.
Disputes are settled by the competent Romanian courts. If you are a consumer, you may sue us either in Romania or in the courts of the place where you live in the European Union, and we may sue you only in the courts of the place where you live (Regulation (EU) No 1215/2012).
19. Other provisions
- Language: the Terms exist in Romanian, English, German, French and Spanish. If the versions conflict, the Romanian version prevails, and if you are a consumer, anything unclear is interpreted in your favour.
- Invalid clauses: if a clause is declared invalid, the rest remain valid.
- Assignment: we may transfer the contract to another company that takes over the site, with prior notice. Your rights stay the same. If you do not agree, you may close your account and, if you have a subscription, we refund the unused part.
- Communications: we write to you at your account email address and in your notifications. You write to us at zmentaro@gmail.com.
